Exemption mode allows features to automatically adjust to comply with CNIL’s cookies guidelines
Certain cookies regulations (e.g. e-Privacy directive) require users' consent before using analytics (or audience measurement) cookies such as those used by Contentsquare. In some jurisdictions, like in France, analytics cookies can be exempted from consent if the exception criteria are met.
The French Data Protection Authority (the CNIL) has listed the Exemption Mode of the Contentsquare Solution as an audience measurement solution exempt from consent in accordance with the CNIL’s cookies guidelines.
Activation
To activate the Exemption mode, please follow the Configuration guide which is at the end of this article (available in English and in French).
What happens when exemption mode is enabled
When enabled, exemption mode disables/adjusts the following capabilities to comply with CNIL's cookies guidelines:
- Session Replay
- Integrations
- Cross-domain tracking
According to the CNIL exemption criteria, and if the Guide is strictly followed, then a cookie banner is no longer required.

Who is eligible for the Exemption Mode?
This option is only available for Contentsquare Enterprise users in France.
When the Exemption Mode is activated do we still need to put Contentsquare in the banner asking for users' consent?
The aim of the Exemption Mode is to provide our customers with an option for experience analytics without their users consent. Customers are therefore exempt from obtaining their users consent if they comply with the CNIL guidelines and implement the settings set out in the Contentsquare Configuration Guide of the Exemption Mode.
However, providing clear and transparent notice (e.g. via a cookie policy) to all customers’ users concerning the purpose of Contentsquare cookies and the use of Contentsquare as a processor is still a requirement. In order to help our customers comply with this requirement, we provide here a description of our cookies that customers can add in their cookie policy.
When exemption mode is enabled, what happens to data and segments created from the disabled features (integrations, session replay)?
Data from disabled features stops being collected once the Exemption mode is activated. However, the data collected prior to the activation is not deleted but is kept securely and is not available. If the Exemption mode is disabled, the data will be available again.
What are the differences between the Exemption Mode and the Cookieless Experience Analytics?
First of all, the objective is different: Cookieless Experience Analytics has been developed by Contentsquare to provide our customers with an alternative version of our experience analytics solution with an increased focus on privacy by using SessionStorage instead of cookies.
However, unlike the Exemption Mode, users’ consent might be required since in some jurisdictions (e.g. in the EU) the SessionStorage might fall under “cookies and other tracking devices” regulations.
Regarding the options, Session Replay is available in the Cookieless Experience Analytics and some third-party integrations are supported.
